On March 11, 2020 Greenpeace Poland filed a lawsuit against PGE GiEK, a subsidiary of state-owned utility PGE Polska Grupa Energetyczna, at the Regional Court in Łódź. According to Greenpeace, the complaint relies on article 323 of the Environmental Protection Law and requests that that PGE GiEK halt any fossil fuel investments and achieve net zero greenhouse gas emissions from its existing coal plants by 2030. Article 323 provides, in part, that "[e]very person who is directly threatened by damage or has suffered damage as a result of illegal impact on the environment may demand that the entity responsible for this threat or violation should restore the state complying with law and take preventive measures."Greenpeace asserts that PGE Polska Grupa Energetyczna is the largest utility in Poland, and derives about 90% of its electricity from coal.
Case documents will be posted when they become available.
