Abstract
In the present case the defendants were licensed to fish in PNG waters but they did not fish in accordance with the license. At trial the court found that s. 55 of the Fisheries Act of 1994 applied only to offences of fishing without a license, and not to fishing in breach of a term or condition of a license. This decision was overturned on appeal, the Appeal Court finding that fishing in breach of a term of a condition of a license was also an offence under the Act.
