Abstract
The reference for preliminary ruling concerned the interpretation of Article 6 of Directive 2006/11/EC on pollution caused by certain dangerous substances discharged into the aquatic environment of the Community. The Conseil dÉtat requested a ruling in connection with a case brought by the Association nationale pour la protection des eaux et rivières claiming misuse of power in particular with regards to decrees on nomenclatures of operations subject to authorisation and of classified facilities. The ECJ concluded that the Directive in question does not give right once programmes to reduce water pollution have been adopted to introduce a declaratory scheme in respect of low-polluting facilities.
