Abstract
This judgment concerns the pollution reduction programmes with regard to List II of the Annex to Directive 76/464/EEC (pollution caused by dangerous substances discharged into the aquatic environment of the Community). The ECJ declared that the documents issued by the Portuguese Government, were merely preparatory acts and of a general nature, describing in very broad terms the plans to be implemented. It found that the documents do not constitute a programme within the meaning of the Directive.
