Taking and moving products belonging to forest property – permission of water and forests office – court appraisal.

If the court is not tied by the description of crime given by the prosecution, it is obliged otherwise to examine the case through documents, and through the investigation it does during the hearings within the power it has according to the law. In this case the court established that facts of this case constitutes elements of taking and moving forests product without the authorization of waters and forests office, which is a misdemeanor according to Article 32 of Dahir 10/10/1917, and thus its decision was well founded.
