Building and living in a forests property – misdemeanor – eviction.

The court convicted the defendant for the misdemeanor of building and living within the forest property confirming hence the ruling of the lower court and adopting its reasons and justifications. Meanwhile it overruled the part of judgment related to eviction because the defendant has lived in the place for a long time and that the water and forests officer did not specify if the residence was recent or not. Consequently, its decision violated the law especially the provisions of Article 53 of the Dahir 10/10/1017.
