The case concerns legality of the resolution adopted by the Cabinet concerning compensation for people affected by noise pollution from Suvarnabhumi International Airport.
The Court found no unlawful exercise of discretionary power by the Cabinet. In particular, the resolution on rules governing assessment of buildings/residence of people affected by noise pollution from Suvarnabhumi International Airport was in compliance with compensatory measures specified in the environmental impact assessment report of the extended airport project and notifications on ambient standards by the National Environment Board. The Cabinet therefore did not exercise its discretionary power in an unlawful manner.
