Abstract

The Centre for Economic Development, Transport and the Environment had given decisions and approved the control of the production of animal production. The case concerned an appeal of the decision. The court concluded that the decision could be appealed to the Supreme Administrative Court without first having to obtain a leave to appeal.  

 

The Centre for Economic Development, Transport and the Environment had in its decisions several complaints about the surveillance of organic production. They also commented on the use of additives in the drinking water of the animals.

 

The court stated that the comments by the Centre for Economic Development, Transport and the Environment were not legally binding, especially regarding the water additives. The decision was therefore in this part not possible to appeal. Instead, the comments were to be seen as a request for the applicant to observe relevant laws and regulations connected to the issue.
