Abstract

The company, Fortum Dalälvens Kraft AB, applied for a permit to construct a new power plant in connection to the existing power plant Untra kraftverk. The plan for the new power plant was to build a new turbine that would replace an existing power plant further down the Dal River. The existing power plant was situated on a stretch of river that was protected from extensions of hydropower plants.

The Land and Environment Court of Appeal found that the effects on the environment of the planned constructions, especially the channels for in- and outflow of water, would be significant.  

Chapter 4 section 6 of the Environmental Code states that water operations that only have a minor impact on the environment are allowed. This was not the case in relation to these plans, and the Land and Environment Court of Appeal concluded that a permit could not be granted.
