The Administrative Court decided that the Office of Atomic Energy for Peace neglected its official duties required by law to ensure secured storage of cobalt-60 radiation source which resulted in damage to the health of the Plaintiffs. The Court therefore ordered the agency to pay damages to the Plaintiffs. The Court reserved its right to revise its decision over damages for medical expenses in the future which has to await future medical evidence. The Supreme Administrative Court upheld the Administrative Court’s decision to dismiss the Plaintiffs’ petition to include additional future medical expenses since these additional expenses were not based on the damages set by the Administrative Court upon the original claims.
