The Court is asked to determine that the State is liable for the damage that a joint association of local authorities for waste management has suffered from the abandonment of the building project of a waste incineration plants.
The applicant argued that the State must be held liable because it has stopped the project while the project was included in the Local Plan for the disposal of household waste of Val de Marne, it broke its promise to build the plant, there were an illegal delay in the instruction of the grant request for classified installations, and the brutal shift in its waste management policy violated the principle of legitimate expectation and legal certainty. The Court rejected all the arguments.
