Abstract

The applicants sought for the Court to quash the decision of the Kenya Forest Service to call for individuals and interested institutions to apply for concessions in state forest plantations and to prohibit the respondent from actualizing the said advertisement and grant concessions and alienate any forest land to individuals and private enterprises. 

The applicants meant that the public did not receive any information before the advertisement and they were not aware that an environmental impact assessment had been conducted. They also meant that the actions of the respondent could have serious consequences for the environment, economy, flora and fauna. They said that forest management could be impaired.

The Court issued an order of certiorari quashing the decision by the respondent and prohibited the granting of concessions to individuals and private enterprises.
