The Constitutional Court is asked to review the constitutionality of the Stockholm Convention on persistant organic pollutants (adopted on 22th May 2001)
The objective of the Stockholm Convention is to protect human health and the environment from persistent organic pollutants. It is one of the objectives of the Rio Declaration (article 15 Rio Declaration), that Burkina Faso has signed.
The Constitution provides a right to health and to an healthy environment and commits the State and citizens to promote, protect and defend these rights (art.26 and 29 Constitution of 2th June 1991).
The Stockholm Convention aims at ensuring the protection of the environment and the human health. It does not include any provisions contrary to the Constitution. Consequently, the Stockholm Convention complies with the Constitution.
