Abstract

The applicant requires the 1st administrative court of the Federal Tribunal to quash the decision of the municipality of Yvonand and of the Cantonal Commission of Vaud refusing to grant him a building permit to build a factory because the planned factory would not have respected the environmental standards of the municipality.

The applicant point out that the planned factory was in line with the federal environmental standards and that the municipality had to apply the federal environmental standards to grant permits.

The court refused to quash the municipal decision to refuse the building permits because it considered that the municipality’s environmental standards were in line with the federal environmental law as it did not contradict it but complemented it.
