Abstract
The appeal was concerning whether the acquisition of land for construction of jail under emergency clauses was justified. After considering the facts of the case, the court held that acquisition was not justified, and that stated that the State government has to follow the various mandates of the Land Acquisition Act including the right of hearing of the land holder under section 5A of the Act.
